Nagarjuna, I believe that if a rapist is also a murderer, it will not matter the consequences. And if a rapist is not a murderer, they will not murder their victim no matter what the consequences. If the consequences are 2 years jail time, or death or life in prison, if a rapist is or is not a murderer, they will act accordingly. A bank robber pretty much already knows in their plans if they are going to kill or not. When the ones that decide to not kill, end up killing people, I highly doubt that they stop to think about how much time they may receive in that moment. I believe it is the same with rapists. But I havent really took the time to really think all of this out yet. I will though, after your next argument to the things I just said.

This may come as a huge shock to you, Denise, but I'm not going to argue too strenuously with what you say. :-) I think you're probabaly right that most people who are sick enough to molest children are not sick enough to murder them afterward even if they wouldn't be punished any more severely for murdering them than they would just for molesting them.
But notice I said "most people." I said this because I believe that there are likely to be a small percentage but nevertheless significant number of individuals who would be sick enough to make the cold-blooded calculation that they have nothing to lose and everything to gain by murdering.
Of course, you could reply that even if I'm right, imposing the death penalty for virtually all sex crimes would probably deter a lot more people from committing any sex crimes than it would encourage those who have committed them to murder their victims; therefore, the overall effect of imposing the death penalty for all sex crimes would be more positive than negative. I doubt that I'd agree with you, but I couldn't prove you wrong at this point.
But then my concern would be that if we start executing everyone convicted of sex crimes of any kind, we drastically increase the chances of executing innocent people, and this is a risk I don't want to see us take.

That's not my theory, Denise. I never said that all of them had no control over their impulses. I said that what determines whether most people act out their impulses is whether the strength of their desire or impulse is greater than the strength of their inhibitions or vice versa. It's this largely unconscious measuring or computation that "controls" the decision. And, for some people, knowing that they could die for murdering their victim but not for merely molesting her or him could decisively tip the balance in favor of NOT murdering the victim.

Convicted sex offender, Phillip Garrido, and his wife, Nancy, are behind bars, awaiting trial for kidnapping and raping an 11-year-old Jaycee Lee Dugard. They are also accused of holding her captive for 18 years in a makeshift backyard compound.
Media attention has focused on Phillip, however, Nancy is accused of being the individual who physically abducted Jaycee from a school bus stop in 1991. She was also allegedly responsible for holding Jaycee captive when Phillip was behind bars from April to August 1993, after his arrest for a parole violation.
The Ski Channel TV Network is reporting that Nancy has been placed in isolation because fellow inmates have threatened to rape and kill her. A source told the network she is “very lonely” and spends most of her time reading the Bible. She is also said to be very cooperative with the ongoing police investigation.

Well, it was some disappointing to me in the fact that if they were able to identify some of the bones as belonging to some of the missing persons, a few families would be able to ease their minds and at least know about their missing loved ones. But on the other hand, those persons still can at least have an iota of hope that their family member is still alive.

Completely off topic: after my last post (about 4:00?), I went upstairs and my dear spouse said "Happy anniversary!" And, by jingo, he was right; it IS our anniversary today. Neither of us had remembered until that moment. So, we went out for dinner, then came home and ate Haagen-Dazs while playing gin rummy (I skunked him; I am GOOD). Now he is studying his German for his class tomorrow (German 101), so our together time is over.
But I'm off to the market to do much-needed stocking up after my vacation. Our cupboard is bare.

But I don't get around much either. I used to live near San Francisco and still live pretty near it, but there are a lot of famous places in that city that I've never visited and probably never will.

I actually have been to the space needle. We lived in Washington when I was small. And I have been to the arch in St. Louis. I live about as far away from St. Louis as you do from San Francisco. And when I lived in Sacramento, I never went to so many of the places right there. I went to Monterey and Santa Cruz alot though. I love Santa Cruz. I love to surf and boogie board. We used to go to San Francisco alot and do nothing. Mostly sit at the ocean. But we never went in the water there.

Well spoken FirstNations, however child rape is punishable in some states by life in prison without possibility of parole, and the inmates do have a special way of treating those. Much better than death I feel. I know first hand, my family has dealt with the same situation just recently. The rape of minors is incredibly common, but kidnapping someone for such a length of time is uncanny.

Hey, Phil, it's me, the voice that's normally in your head. Here's what I want you to do for me--next time you're in the prison shower, make sure you drop the soap on purpose, then bend way over to pick it up. Make sure your legs are spread far apart, and try to wiggle your butt cheeks a little. As you do, say in a loud voice, "Oh! I've dropped the soap. Let me just bend right over and pick it up." I really don't care what happens to the sick captors. I am just grateful that Jaycee is home, safe, and in the company of her family who have waited 18 years for her safe return. Now the state of Calif needs to ensure that they get all the help they will need for a long and horrendous recovery. The state of Calif failed them at least twice when neighbors asked police to investigate the property because they knew children lived there. Parole officers say they couldn't see the shacks the three victims were held in. I don't buy it. Neighbors call to report they see children on the property of a convicted sex offender, but law enforcement never do a real search of the property. Thank God for the astute female, mother, police officer at the University. Please say a prayer for Jaycee and her family.

These responses are as violent as Garrido in many ways. Yes, he's obviously a horrifying, narcissistic sociopath who needs to be locked up forever, and that's in fact what will happen to him. But in modern societies we don't practice an eye for an eye, tooth for a tooth justice - that would turn us all immediately into monsters. Is that what people here want? Please. And there is too much amateur psychiatric diagnosis going on. Schizophrenia is not statistically associated with violence; it's almost universally associated with withdrawal and suicide. These rash assertions are not helping anyone, particularly not the mentally ill. There is something profoundly sociopathic going on with Garrido, involving psychosis and probably other conditions and forms of damage, but even that doesn't mean he'll get off on an "psychologically incompetent to stand trial" argument. It takes a lot to make that argument stick, it almost never happens, and it's very unlikely in this case. He is likely to be sent to regular prison but be separated from the rest of the inmate population, though that's not assured. But it's clear he'll never be let out again. People need to be a little bit more circumspect with their violent, vengeful impulses. I think those uttering threats would be very suprised how much they'd like living in a true vigilante justice society. There's a saying: we tend to come to resemble the thing we most oppose in others. Instead, let's assert our own humanity and make sure the victims are not harrassed while they recover, to whatever extent they are able to recover.

1. Garrido has not read the Scriptures, because they tell him to do the opposite of what Garrido has done.
